The Law of Agency is one of the most important – and most misunderstood – concepts in the world of real estate. It addresses one crucial question: who is the agent working for, and who do they owe the responsibility to? Answers to these questions must be clearly established at the outset of the relationship.

What you will learn
- Define agency and define and identify the terms often used in the discussion of agency: agent, principal, fiduciary, client, and customer;
- Describe and identify universal agent, general agent, special agent, and agency coupled with an interest, and describe the scope of authority granted under each;
- Describe how agency relationships are created and define express and implied agency;
- Describe basic agency relationships and the issues surrounding those relationships and describe and identify characteristics of agency relationships when the seller is the principal, the buyer is the principal or broker is the principal;
- Identify and describe the six fiduciary duties an agent has to the principal, and state what happens if an agent breaches these duties;
- Describe and explain an agent’s duties to third-party customers, especially regarding misstatements, misrepresentation, and potential fraud;
- Explain who may compensate the broker and how compensation is negotiated;
- Discuss the ways in which agency relationships can be terminated; and
- Summarize the four distinct acts that violate antitrust laws and penalties for violations.
About Our Instructors

Kristin Pelatti
Kristin R. Pelatti is a real estate/land use attorney and CEO of Assure Abstract. Kristin attended Siena College earning a B.S. in Accounting and Pre-Law Certificate. While in college, Kristin received her real estate license and began working as a salesperson at Keller Williams Hudson Valley Realty. As college went on her love for real estate and law grew and she was accepted into the accelerated program at Pace University School of Law. Kristin was on the executive board of the Pace Environmental Law Review and an active volunteer in the Land Use Law Center. Kristin graduated in 2018 with her Juris Doctor with a concentration in Real Estate and Land Use Law. Kristin was admitted to the New York State Bar and began practicing as a Real Estate and Land Use attorney. While practicing, she was accepted into a Fellowship at Pace University School of Law as the Land Use Law Fellow and received her LLM in Environmental Law with a concentration on Land Use and Sustainable Development. Kristin actively worked at this time with the Land Use Law Center facilitating numerous trainings for land use board of municipalities within New York. After her Fellowship, Kristin worked at MarksDiPalermo, PLLC as a Real Estate and Municipal Law Associate. In this positions she served as Deputy Corporation Council for the City of Rye. Kristin continued to represent buyers, sellers, lenders and investors in real estate transactions and as counsel for developers in various development projects appearing before land use boards for approvals needed. In 2021 Kristin co-founded Assure Abstract a title company focused on serving the Hudson Valley not only through title services but its philanthropic efforts to assist the communities it serves. Kristin is a member for BNI Alliance Builders and the New York State Bar Association.
